Stays in the guest rooms at Le Couvent des Ecrevisses

Article 1 – Purpose

These terms and conditions are intended for the exclusive use of stays booked in guest rooms at “Le Couvent des Ecrevisses”, 12 Rue des Audiffren, 83670 Barjols, France. They constitute the booking contract between SARL Le Couvent des Ecrevisses and the client for a stay in a guest room.

The best conditions will be offered to clients on arrival. The owner undertakes to ensure the reception of clients in person with all the desirable attentions to facilitate their stay and share knowledge of the region.

Article 2 – Length of stay

The client rents one or more rooms for a fixed period and may not under any circumstances claim any right to remain on the premises after this period without prior agreement from the owner of the company Le Couvent des Écrevisses.

Article 3 – Validation of a booking

A booking can be made on the website www.lecouventdesecrevisses.fr, by email or by telephone directly with the owner or through a reservation website offering the bed and breakfast service of this establishment.

Validation of the booking implies acceptance of these terms & conditions for guest rooms. For bookings made on the website, the client will receive, by email, a booking confirmation having the value of a contract.

Article 4 – Cancellation by the client

Any cancellation must be notified by post or email to the owner.

a) Cancellation before the start of the stay :

No charges are applied for cancellation more than 5 days before the start of the stay, the deposit paid to the owner will be returned to the client.

If the cancellation occurs between 5 days and 24 hours before the start of the stay, the deposit will be retained by the owner.

If the cancellation occurs less than 24 hours before the start of the stay, the deposit will be retained by the owner who also reserves the right to claim the balance of the total price of the booking.

b) If the customer does not arrive before 8pm on the scheduled start day of the stay (without prior notice of late arrival), this contract becomes null, and void and the owner can dispose of his guest rooms for another booking. The deposit will be retained by the owner who also reserves the right to claim the balance of the total price of the booking.

c) In the event of a shortened stay, the amount corresponding to the total cost of the booking will be retained by the owner.

Article 5 – Cancellation by the owner

In the case that before the start of the stay, the owner must cancel this booking, for reasons beyond his control, he must inform the client as soon as possible by telephone or email.

The client, without prejudice to any recourse for compensation for any damages suffered, will be reimbursed immediately for the amount paid for the booking.

Article 6 – Arrival and departures

The client must arrive on the day specified for the booking and at the times mentioned below. The rooms are available from 4:30pm on the arrival date. In the event of arrival after 8pm, the client must notify the owner as soon as possible. Arrivals after 10pm are not possible and the owner reserves the right to refuse access to the client after these times. This refusal can in no case be considered as a modification or termination of the contract at the initiative of the owner, and therefore no refund can be considered.

The rooms must be vacated by 11am. After 12 noon, the client will be charged for an additional night.

Article 7 – Breakfast

Breakfast is served between 8:30am and 10am. A margin of 15 minutes before or after this time slot is accepted, upon request of the client.

Article 8 – Payment of the balance

The balance of the booking will be paid at the end of the stay.

The payment of the balance can be made in cash, by check or credit card.

Holiday vouchers (If the amount of the holiday vouchers exceeds the amount of the rental, the client cannot claim any reimbursement of the difference)

Additional consumption and/or services not mentioned in the contract or estimate will be paid to the owner at the end of the stay.

Article 9 – Tourist tax

Tourist tax is a local tax that the client must pay to the owner who then pays it to the public treasury. It is not included in the price of the night. It is calculated per person and per number of nights.

Article 10 – Change of rooms

Without the client being able to claim any compensation, the owner reserves the right to change the room initially reserved by the client for a room of the same or higher capacity. In such a case, the cost of the booking remains unchanged.

Article 11 – Capacity

The booking is made for a specific number of people. If on the day of arrival, the number of guests exceeds this number (including babies), without prior notice in writing, the owner has the right to refuse the additional guests.

This refusal can in no case be considered as a modification or termination of the contract at the initiative of the owner, therefore in the event of the departure of a number of guests greater than those refused, no refund can be considered.

Article 12 – Pets

Pets are not accepted. In the event of non-compliance with this clause by the client, the refusal to accept animals and their owners by the owner of the guest rooms cannot be considered as a modification or termination of the contract at the initiative of the owner, therefore, in the event of the client’s departure, no refund can be considered.

Article 13 – “Art de vivre” (etiquette), use of the premises

Respect for a certain level of etiquette is requested of all clients to guarantee the peaceful nature of the premises and the comfort of its guests. For the well-being of everyone, noise after 11:00pm is forbidden.

In addition, “Le Couvent des Ecrevisses” is an entirely non-smoking area, except for the terrace and the garden (ashtrays are provided).

No meals may be consumed in the rooms. The client agrees to respect the etiquette instructions appearing in the rooms and in these terms & conditions. The client agrees to return the rooms in perfect condition at the end of the stay and to declare and assume financial responsibility for any possible damage for which he or she may be responsible.

Children staying at the “Couvent des Ecrevisses” are the sole responsibility of their parents.

In addition, the client agrees not to use the WIFI service, offered free of charge, for illicit, prohibited or illegal purposes.

Valuable personal belongings, it is recommended not to leave valuable objects in the rooms.

Article 14- Table d’hôtes

The table d’hôtes service is reserved exclusively for guests staying on site. Dinner is served at 7.30pm for all guests, in the dining room of the house. Customers must book the table d’hôte service by 10am the day before. Table d’hôtes is only available in low season ( from October 1st to March 31st), on Sundays, Mondays and Tuesdays. The price includes 3 courses (main course – cheese – dessert), wine is extra.

Article 15

These terms & conditions may be modified at any time without notice. Acceptance and compliance with these terms & conditions are deemed to have been acquired by the client upon reservation.

Article 16 – Data Protection and Liberties

In accordance with the law of 6 January 1978, you have the right to access and rectify data concerning you. “Le Couvent des Ecrevisses” undertakes not to transmit the information you have communicated to other companies or organisations.

Article 17

Conditions, prices and offers are not contractual and subject to change without notice.

Stays in furnished tourist accommodation “la petite maison” at Le Couvent des Ecrevisses

Article 1 – Purpose

This seasonal rental contract is reserved for the exclusive use of rental and accommodation in the furnished tourist accommodation “la petite maison” located at “Le Couvent des Ecrevisses” (12 rue des Audiffren – 83670 Barjols France) and operated by the company SARL Le Couvent des Ecrevisses.

Article 2 – Duration of stay

The tenant signing this contract for a fixed period may not under any circumstances claim any right to remain on the premises at the end of the stay.

Article 3 – Conclusion of the contract

The booking becomes effective once the tenant has sent the owner a deposit of 50% of the total rental amount and a copy of the signed rental contract.

The rental concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, whether natural or legal persons or entities, unless the owner agrees in writing.

Any breach of this previous paragraph may result in the immediate termination of the rental due to the tenant’s fault, with the rental proceeds remaining definitively retained by the owner.

Article 4 – Termination of the contract

The name, first name and age of each tenant will be requested before arrival by our services including those of any children.

The age of the children is calculated in relation to their age on the start date of the stay. An official document justifying the age of the children may be requested at the start of the stay. Minors unaccompanied by their parents or an adult legal guardian will not be admitted for obvious security reasons (weather alert, hospitalisation, severe weather, illness, etc.)

Bank card: Mastercard, Eurocard, Visa, American Express

Holiday vouchers (If the amount of the holiday vouchers exceeds the rental amount, the tenant cannot claim any refund of the difference).

It is imperative to mention the reference of the reservation with the payment.

Article 5 – Cancellation by the owner

In the case that before the start of the stay, the owner cancels this stay, for reasons beyond his control, he must inform the tenant as soon as possible by telephone or email.

The tenant, without prejudice to any recourse for compensation for any damage suffered, will be reimbursed immediately for the amounts paid.

Article 6 – Rates

The rates for stays have no contractual value and may be modified without notice. The contractual price is the one set at the time of booking excluding tourist taxes (and except for excessive consumption of water and electricity).

The price set at the time of booking includes the rental of the furnished equipped tourist accommodation from the day of arrival to the day of departure, mattress with cover and pillows, the supply of sheets, duvet covers, pillowcases, optional towels.

Article 7 – Tourist tax

Tourist tax is a local tax that the tenant must pay to the owner who then pays it to the public treasury. It is not included in the price of the night. It is calculated per person and per number of nights.

Article 8 – Capacity

This contract is established for a maximum capacity of 4 people (children included) and corresponds to the maximum occupancy authorised taking into account the available equipment. It cannot be exceeded for safety and insurance reasons. The owner reserves the right to refuse access to the accommodation if the number of people exceeds the maximum authorised occupancy (possibility of renting guest rooms at the Couvent des Ecrevisses if necessary).

Article 9 – Modification of the stay

Any requested modification of the stay in terms of dates, duration, number of people or family composition must be validated by the owner. It may, if necessary, be subject to additional invoicing.

In the event of external events beyond our control, we may be required to modify or cancel the stay. We will then offer, subject to availability, an equivalent stay with different dates. If this offer is not satisfactory, the full amount paid will be refunded to the tenant. No other compensation may be claimed.

Article 10 – Absence and withdrawal

For bookings made by mail, telephone or internet, the tenant does not benefit from the withdrawal period, in accordance with article L121-21-8 of the consumer code in French law relating in particular to accommodation services provided on a specific date or at a specific frequency.

Article 11 – Cancellation by the tenant

Any cancellation must be notified by email or registered letter to the owner.

Cancellation before arrival on the premises :

The deposit will be retained by the owner for any stay cancelled more than 30 days before the planned arrival date. For any stay cancelled within 30 days prior to the arrival date, interrupted or not consumed for any reason whatsoever, the entire amount of the booking will be owed or will be retained by Le Couvent des Ecrevisses. No refund is provided in the event of interruption of the stay. In addition, if the stay is shortened, the total amount remains acquired by the owner.

If the tenant does not arrive within 24 hours following the arrival date indicated on the contract, this contract becomes null, and void and the owner can dispose of his furnished tourist accommodation for other purposes. The deposit will be retained by the owner who will request payment of the balance of the rental. No refund may be requested by the tenant.

Article 12 – Cancellation by the owner

The client, without prejudice to any recourse for compensation for any damage suffered, will be reimbursed immediately for the amount paid for the booking.

Article 13 – Arrival and departure times

The tenant must arrive on the day specified in the contract from 4:30pm. In the event of a late arrival (after 8:00pm) or a delayed arrival, the client must notify the owner as soon as possible.

The tenant must leave the premises no later than 11:00am.

Article 14– Payment of the balance

The balance of the rental is to be paid upon entering the premises.

Article 15 – Inventory

An inventory is drawn up jointly and signed by the tenant and the owner or his representative upon arrival and departure of the furnished tourist accommodation. This inventory constitutes the only reference in the event of a dispute concerning the inventory.

The state of cleanliness of the furnished tourist accommodation upon the tenant’s arrival must be noted in the inventory. Cleaning of the premises is the tenant’s responsibility during the rental period. When the tenant leaves, the furnished tourist accommodation must be tidy and in a suitable state of cleanliness.

A cleaning service invoiced at €50 is the responsibility of the tenant and includes end-of-stay cleaning (linen and cleaning).

Article 16 – Security deposit/deposit

Upon the arrival of the tenant, a security deposit of €300 will be requested from the tenant. This security deposit must be made by check (French bank account) payable to Le Couvent des Ecrevisses or in cash (Euros). After the exit inventory carried out by the owner or representative of the establishment, this deposit is returned, minus the cost of restoring the premises if damage was noted or items are missing.

Article 17 – Use of the premises

The owner will provide the accommodation in accordance with the inventory he has carried out and will keep it in working order.

The tenant must ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises.

The equipment and facilities of the site must be used in accordance with their destined purpose. All equipment listed in the inventory must be returned to the place it occupied when entering the premises. The named tenant on the contract is personally responsible for all damage, loss or deterioration caused to the accommodation itself and its contents as well as to all the facilities of the site, committed by himself or the people (or animals) who stay with him, or visit him.

Events such as birthdays, student evenings, bachelor or bachelorette parties or other private events are not permitted inside or outside (terrace and private garden) of the furnished tourist accommodation.

Article 18 – Pets

Pets are accepted under certain conditions. In the event of non-compliance with the defined conditions, the owner may refuse or shorten the stay. In this case, no refund will be made.

Conditions concerning pets : – One pet only (les NAC ne sont pas acceptés)

– The animal cannot move freely in the common areas of the Couvent des Ecrevisses house and must be kept on a leash at all times.

– The animal cannot remain alone in the furnished tourist accommodation or outside.

– The droppings or dirt left by the animal must be picked up and/or cleaned by the tenant, both inside the furnished tourist accommodation and outside (terrace and garden). A trash can and a shovel specially designed for this purpose will be made available.

– The animal must be identified by tattoo or electronic chip certified by a card issued by the Société Centrale Canine (or equivalent in the country of origin). Proof of up-to-date vaccinations is required.

Article 19 – Insurance

The named tenant is responsible for all damages caused by him, other people listed on the contract, guests visiting him and any pets. He is required to be insured by a holiday insurance contract for these various risks.

Within the entire property, children are the sole responsibility of their parents. The tenant is required to immediately notify the owner of any damage that occurs. If the tenant does not respect the above rules, the owner may take the necessary measures, which may include premature termination of the offending tenant’s stay without recourse to a refund.

Article -20 Valuables

It is recommended not to leave valuable belongings in the accommodation. The owners are not responsible for any loss or damage to personal property.

Article – 21 Payment of charges

At the end of the stay, the tenant must pay the owner for the options and paid services used by the tenant during his stay and not included in the price.

Article 22 – Complaints and disputes

Any complaint relating to the condition of the premises and the condition of the description during a rental must be submitted to both parties by registered mail within 15 days following the stay to the following address: Le Couvent des Ecrevisses – 12 Rue des Audiffren – 83670 Barjols.

In the event of a dispute, only the jurisdiction of the Court of Draguignan is recognised.

Article 23 – WIFI

Wifi is free with a secured access in the accommodation. The tenant agrees not to use the WIFI service, offered free of charge, for illicit, prohibited or illegal purposes.

Article 24 – Smoking

Smoking is prohibited inside the furnished tourist accommodation for the entire duration of the stay. However, it is possible to smoke on the terrace of the accommodation where an ashtray is provided. Cigarette butts must not, under any circumstances, be thrown on the ground or in the garden.

Rules and regulations of furnished tourist accommodation

The Couvent des Ecrevisses is not liable in the event of non-compliance with the rules and regulations and safety instructions relating to this type of accommodation structure.

Tenants are required to comply with the rules and regulations relating to this type of accommodation structure during the stay.

1 – Ecological responsibility: In the dry season, the risk of fire is present everywhere in the countryside. Be careful with barbecue embers. It is absolutely forbidden to light an open fire anywhere on the property and in the surrounding area.

2 – Precautions: All equipment and facilities are made available to you, you are asked to use them respectfully, ensuring normal operation and reasonable consumption (water, electricity, etc.).

3 – The layout: The accommodation layout has been designed for optimum use for the present and future and to ensure quality of reception. Bedding, furniture and other objects must not be transported outside the accommodation.

4 – Breakages: In the event of damage or breakage, report it immediately inform the owner of any damage or loss occurring in the rented premises, even if no apparent damage results.

5 – Maintenance and upkeep of the rented premises: Everyone is required to refrain from any action that could harm the cleanliness, hygiene and appearance of the premises both inside the accommodation and outside and in the surrounding areas.

Please note the accommodation must be tidy when you leave. (The tenant is required to maintain the rented premises during the stay in the same condition as on arrival and to return it in good condition of rental repair. (Conditions at the end of the regulations).

 

6 – Tenants and users are financially responsible for any damage they may cause through their actions. They are responsible for any incidents or accidents that may occur to them or to third parties due to their failure to comply with these regulations. They must comply with the WIFI conditions of use. (see Terms & Conditions)

7 – Meadow and green spaces. Picking flowers, fruit and breaking branches is prohibited on the grounds and its surroundings.

8 – Noise and disturbance : Although the garden of the furnished tourist accommodation is private, it is directly adjacent to the garden and the main house intended for the owners and guests of the guest rooms. For this reason, everyone is required to ensure the peaceful nature of the premises noise is forbidden after 11pm.

9- Smoking: Smoking is prohibited inside the premises.

 

Conditions for restoring the guest house to its correct state

Tenant’s obligations:

-Furniture, tables & chairs put away.

KITCHEN -Fridges & freezers emptied

-Coffee machines, kitchen appliances and tableware & kitchenware washed, put away in place.

OUTSIDE, terrace, garden…

Furniture put away and bbq covered.

BEDROOMS

-Furniture in place.

-All linen to be placed in a basket provided for this purpose.

-Towels and bed linen returned.

Any failure to comply with these rules will result in an additional invoice.
